If you have been driving under the influence, you will likely assume that there is no way that the case can be won. You may have caused an accident or you may have taken a breathalyser test and you may then assume that the case is clearly lost. But this is not necessarily the case. If you work with a DUI attorney who has had experience having charges dropped against those who have been charged with a DUI, there is a good chance that he or she will be able to have your charges dropped as well. You may be surprised at how weak the case actually is against you.

Not All Attorneys Are A Good Fit

To determine if a DUI attorney is right for you, it is important to consider whether he or she has had specific training to handle DUI cases. Also, he or she should have experience handling these cases and should have a track record for winning cases. If the DUI attorney has not handled a DUI case in awhile, it may be risky to hire him or her.

The Breathalyser Might Be Inadmissible

Even if your blood alcohol level was over the legal limit, you may still be able to win the case by finding that the breathalyser is inadmissible. For example, there may have not been sufficient grounds to stop you in the first place. Even if you are driving under the influence, if you are not committing a specific crime and if there is not evidence that you are driving under the influence, there is little or no reason for you to have been given a breathalyser test. There may not have been grounds to perform a sobriety test. If the test was performed, it might not have been performed properly. The dashcam footage might reveal that there was not sufficient evidence that you were intoxicated and this may lead to the test being considered unreliable.

Each case is different and the consequences of being found guilty of a DUI are much worse than the cost of hiring a DUI attorney. It is important to find a DUI attorney as soon as possible because the sooner the discovery process begins to gather evidence to support your case, the more likely that you will win.
